www.loudlabs.com NUEVO - The California Highway Patrol along with Cal Fire/ Riverside County Fire responded to a solo vehicle traffic accident in Nuevo. According to the CHP log, a male adult and a baby were inside a pick up truck that crashed into a tree at Hansen and Lakeview Avenues. California Highway Patrol Officers at the scene declined to provide any details on the fatal accident. Per April Newman of Cal Fire/ Riverside County Fire, arriving Fire personnel found a solo vehicle into a tree with two occupants inside. One adult patient was declared deceased at the scene and a juvenile was treated at the scene for minor injuries and refused transport. A male at the scene was seen being given a field sobriety test and placed in handcuffs. The cause of the fatal accident is currently under investigation.

By: Bryant Maddrick LANCASTER, Pa. -- A strict sentence was handed down to a man responsible for killing a teen in a drunk driving accident. Another family grieves the loss of a loved one to a drunk driver. "We lost an irreplaceable member of our family due to a tragic crime that could have been avoided," said Samantha Demko, sister of Meredith Demko who was killed last summer. Chris Demko, Meredith Demko's father, is still angry about his daughter death. "This tragedy was avoidable. The DUI issue in the state is unacceptable. This is a case that should have never happened," Chris said. Meredith Demko was just 18 when she was killed in July in a fatal crash in East Lampeter Township. Witnesses said Thomas Gallagher, Jr. was behind the wheel of his vehicle when it swerved directly into Demko's path. On Wednesday, Gallagher was sentenced to 20 to 50 years in jail. "The biggest sentence we had in institutional memory for a case like this here," Lancaster County District Attorney Craig Stedman said. But is the sentence a game changer when it comes to prosecuting fatal DUI accident? T.C. Tanski, Appellate and Post-Conviction Attorney with The McShane Firm says no. "Pennsylvania by and large adopts a, what I like to call, an individualized sentencing calculus. What that means is under Pennsylvania law the goal of our sentencing code is to apply to a particular defendant," Tanski said. In other words, there's no one size fits all punishment for a DUI related death. Tanski explains there are several factors that can determine a sentence. "The rehabilitation of that particular defendant. The safety of the community at large as well as hearing from the victims and from the defendants themselves if they want to afford allocution," Tanksi said. It means the defendant would take responsibility for their actions. Gallagher's attorney explains his client was suffering from a terrible addiction that was out of control when the accident occurred. Stedman says the incident should have never happened. "So easily preventable," Stedman said. "So many choices led to this terrible outcome." Gallagher will spend a minimum of 20 years behind bars for the fatal accident.

Speaking for the first time to media, Barnd shared his story and joined Pogones with a message to help stop the loss of life and heartache caused by drunk driving. Most people think about a sober ride home when making their New Year’s plans, but statistics show motorists need to pay just as much attention to other holidays. The percentage of drunk-driving related deaths compared with total traffic fatalities is significantly higher for Thanksgiving and Christmas than other major holidays. Alcohol is the leading cause of fatalities on Minnesota roads with one in four deaths drunk driving related. In the last five years (2010 – 2014), there were 479 drunk driving-related traffic deaths in Minnesota, 88 in 2014 alone.

DAYTON -- A Dayton family struggling to make ends meet "Me and my son was in a homeless shelter by ourselves for four months," said Christopher Hambidge. Now they have to deal with losing their car. A driver plowed through a neighbors yard then hit their SUV "Appeared to be intoxicated, was non responsive," said Hambidge. The crash did a lot of damage. There's a big dent, the window is broken out It'll take a lot to fix it. The owner has already dealt with hardship and this is the last thing he needed. All Christopher Hambidge and his wife can do is look at the damage done to their SUV.. Earlier this morning someone smashed it up. "Sound like something hit the side of my house, I thought it was a tree branch or something," said Hambidge. He came outside and saw two people in a car. "The driver was sleeping right along with a passenger, um appeared to be intoxicated," said Hambidge. They were sleeping or passed out? he was asked. "Sleeping. Snoring , sleeping," said Hambidge. The driver was coming down Eichelberger Avenue. He hit another car there, knocking off the bumper and then came across the neighbors yard, where there are still tire marks, crashed into a fence and then hit Hambidge's car. I was like what in the world is going on. I was like you guys didn't wake up from jumping a hill and crashing into a car? said Hambidge. He called the police and said it took several minutes for officers to wake the men up. "They did find half a bottle of Absolute Vodka in the backseat," said Hambidge. Hes glad his car was parked there to block the other car from crashing into his house and the room where his 22 months old was sleeping. Now he's just hoping the driver has insurance. "I've already struggled, long story short I just got out of a homeless shelter," said Hambidge. "We finally got our own place. I worked so hard to get the car. I have and everything we've fought for. and someone who's drinking and driving and not paying attention to what they're doing and turn around and about to ruin everything we've worked for," said Hambige. The SUV is Hambidges only means of transportation so he needs it. He recently had to spend 00 on the car and he doesn't have much income. He has to check back with police to find out if that other driver has insurance.

If someone has too much to drink at bar or restaurant in Lower Paxton Township, the bartender can make a very important call that could save a life -- a call to a cab. This is good news for Lower Paxton Township establishments that serve beer and liquor. For the next couple of weeks the Blue Moose in Linglestown expects to see more people celebrating. Manager Amanda Grigor is thrilled about this program which starts Dec. 15. "Everybody likes to go out during the holidays and you don't want to risk injuring somebody else," Grigor said. It's be called Alert Cab, a partnership with Lower Paxton Township Police, Wilsbach Distributors, and American Cab. "We want to serve people in Lower Paxton Township and want everybody in Harrisburg to be happy and to be safe," said Max Takukam with American Taxi. Thursday night people were also reminded how important this type of effort is. At the DUI Victims Memorial Garden more names were to be added to a pathway already filled with so much sadness. The names etched on paving stones, all victims of drunk driving. Nicole Schlegel, of Juniata, went with her mother and another family member. "My family is here today for my Mom's sister, Joyce Yetter, who was killed by a drunk driver," Schlegel said. The crowed placed red bows on a Christmas tree in memory of their loved ones. "Until I die, it will never go away, never go away," said Deborah Schlegel. The Alert Cab will be in operation until Jan. 7.
