Various shots of Saltillo morgue exterior STORYLINE: Officials in northern Mexico say a drunk driver lost control of his tractor-trailer on Monday and slammed into a bus carrying Canadian and American tourists, killing 11 people. Seven Americans, three Canadians and the Mexican bus driver were killed, police in northern Coahuila state said. Among the crash victims are two Texas middle school teachers on spring break, a retiree from Iowa and a Quebec business consultant easing into retirement with a tour of the US and Mexico. Many of those caught up in the crash were so-called "snowbirds" from colder climes who spent their winters in Texas' Rio Grande Valley. A spokesman for the US consulate in the nearby city of Monterrey, said nine Americans were injured and that most were in stable condition. One man, from Texas, remained in intensive care because of a head injury, according to doctor Jorge Fuentes at the Muguerza Hospital, where the man was being treated. Mexican federal agents said said the tractor-trailer driver lost control, swerved onto the shoulder to his left, then overcompensated to the right and crashed into the bus coming from the opposite direction. State civil defence officials said 16 people were injured, many seriously. Officials said the truck driver, who was among those hurt, had been intoxicated and would be charged with involuntary homicide. Two of those killed were middle-school reading teachers at Cummings Middle School in Brownsville, Texas: Ana Maria Bujanos of Brownsville and Rebecca Pemelton of Harlingen. The Canadian Press news agency identified the Canadians who died as Robert Lacas, 56, of Quebec, Carolyn Kowaleski, 68, of Caledonia, Ontario, and Marilyn Jackson, 67, of Vancouver. Mexico's Foreign Relations Department issued a statement expressing its "most sincere condolences" to the victims' families and it offered to help with any paperwork the relatives may face. Didn't happen. Instead she opens a bar and grill. Brags about Bloody Mary's and "Living The Dream". "Life is good" she posted to a picture on a trip to the beach to collect sand. Life hasn't been good for the families who's daughters, sisters, granddaughters, friends she took away.

Victim: Drunk Driver Crashes into Family Car, Nearly Missing
DAYTON -- A Dayton family struggling to make ends meet "Me and my son was in a homeless shelter by ourselves for four months," said Christopher Hambidge. Now they have to deal with losing their car. A driver plowed through a neighbors yard then hit their SUV "Appeared to be intoxicated, was non responsive," said Hambidge. The crash did a lot of damage. There's a big dent, the window is broken out It'll take a lot to fix it. The owner has already dealt with hardship and this is the last thing he needed. All Christopher Hambidge and his wife can do is look at the damage done to their SUV.. Earlier this morning someone smashed it up. "Sound like something hit the side of my house, I thought it was a tree branch or something," said Hambidge. He came outside and saw two people in a car. "The driver was sleeping right along with a passenger, um appeared to be intoxicated," said Hambidge. They were sleeping or passed out? he was asked. "Sleeping. Snoring , sleeping," said Hambidge. The driver was coming down Eichelberger Avenue. He hit another car there, knocking off the bumper and then came across the neighbors yard, where there are still tire marks, crashed into a fence and then hit Hambidge's car. I was like what in the world is going on. I was like you guys didn't wake up from jumping a hill and crashing into a car? said Hambidge. He called the police and said it took several minutes for officers to wake the men up. "They did find half a bottle of Absolute Vodka in the backseat," said Hambidge. Hes glad his car was parked there to block the other car from crashing into his house and the room where his 22 months old was sleeping. Now he's just hoping the driver has insurance. "I've already struggled, long story short I just got out of a homeless shelter," said Hambidge. "We finally got our own place. I worked so hard to get the car. I have and everything we've fought for. and someone who's drinking and driving and not paying attention to what they're doing and turn around and about to ruin everything we've worked for," said Hambige. The SUV is Hambidges only means of transportation so he needs it. He recently had to spend 00 on the car and he doesn't have much income. He has to check back with police to find out if that other driver has insurance.

Family of drunk driving victim speaks
By: Bryant Maddrick LANCASTER, Pa. -- A strict sentence was handed down to a man responsible for killing a teen in a drunk driving accident. Another family grieves the loss of a loved one to a drunk driver. "We lost an irreplaceable member of our family due to a tragic crime that could have been avoided," said Samantha Demko, sister of Meredith Demko who was killed last summer. Chris Demko, Meredith Demko's father, is still angry about his daughter death. "This tragedy was avoidable. The DUI issue in the state is unacceptable. This is a case that should have never happened," Chris said. Meredith Demko was just 18 when she was killed in July in a fatal crash in East Lampeter Township. Witnesses said Thomas Gallagher, Jr. was behind the wheel of his vehicle when it swerved directly into Demko's path. On Wednesday, Gallagher was sentenced to 20 to 50 years in jail. "The biggest sentence we had in institutional memory for a case like this here," Lancaster County District Attorney Craig Stedman said. But is the sentence a game changer when it comes to prosecuting fatal DUI accident? T.C. Tanski, Appellate and Post-Conviction Attorney with The McShane Firm says no. "Pennsylvania by and large adopts a, what I like to call, an individualized sentencing calculus. What that means is under Pennsylvania law the goal of our sentencing code is to apply to a particular defendant," Tanski said. In other words, there's no one size fits all punishment for a DUI related death. Tanski explains there are several factors that can determine a sentence. "The rehabilitation of that particular defendant. The safety of the community at large as well as hearing from the victims and from the defendants themselves if they want to afford allocution," Tanksi said. It means the defendant would take responsibility for their actions. Gallagher's attorney explains his client was suffering from a terrible addiction that was out of control when the accident occurred. Stedman says the incident should have never happened. "So easily preventable," Stedman said. "So many choices led to this terrible outcome." Gallagher will spend a minimum of 20 years behind bars for the fatal accident.

Community provides free cab rides for drinkers, drunk driving victims remembered
Reported By: Donna Kirker Morgan LOWER PAXTON TOWNSHIP, Pa. -- One Dauphin County community has come up with a plan to provide free taxi cab rides for drunken patrons during the weeks around Christmas. If someone has too much to drink at bar or restaurant in Lower Paxton Township, the bartender can make a very important call that could save a life -- a call to a cab. This is good news for Lower Paxton Township establishments that serve beer and liquor. For the next couple of weeks the Blue Moose in Linglestown expects to see more people celebrating. Manager Amanda Grigor is thrilled about this program which starts Dec. 15. "Everybody likes to go out during the holidays and you don't want to risk injuring somebody else," Grigor said. It's be called Alert Cab, a partnership with Lower Paxton Township Police, Wilsbach Distributors, and American Cab. "We want to serve people in Lower Paxton Township and want everybody in Harrisburg to be happy and to be safe," said Max Takukam with American Taxi. Thursday night people were also reminded how important this type of effort is. At the DUI Victims Memorial Garden more names were to be added to a pathway already filled with so much sadness. The names etched on paving stones, all victims of drunk driving. Nicole Schlegel, of Juniata, went with her mother and another family member. "My family is here today for my Mom's sister, Joyce Yetter, who was killed by a drunk driver," Schlegel said. The crowed placed red bows on a Christmas tree in memory of their loved ones. "Until I die, it will never go away, never go away," said Deborah Schlegel. The Alert Cab will be in operation until Jan. 7.

Holding Drunk or Drug-Impaired Drivers Responsible
http://www.personalinjury.com John Day is a personal injury attorney in Nashville, Tennessee, who has been representing the victims the victims of drunk drivers for 34 years. In today’s video, Larry Bodine, editor in chief of PersonalInjury.com, interviews him about drunk driving and impaired drivers. There is great news about the reduction in deaths caused by people who’ve consumed alcohol. In the last 25 years the number of deaths caused by drunk drivers is down almost 35%. However, the bad news is that many other drivers are impaired by prescription drugs. There is an increase in use of prescription drugs and narcotics that can affect your ability to drive. National statistics indicate that the number of impaired rivers is up 25% over the last eight years. In fact, 15% of drivers involved in accidents have the presence of narcotics in their systems. Drunk drivers can be charged with the crime of DUI of DWI. They may go to jail and may their license. But the driver can also be liable for civil damages to anyone they’ve harmed. The drunk driver may have to pay their victim’s medical bills, the loss of earnings, and damages for pain and suffering. If a judge or jury finds that the driver acted recklessly -- that is with conscious indifference to the consequences – he can be held liable for punitive damages. The financial consequence are quite severe. Bars and restaurants liable Many states permit “dram shop” actions against bars, restaurants and convenience stories that sell to obviously intoxicated persons, or to minors. “There is accountability in the law. We’ve seen some significant verdicts and settlements for bars and restaurants that continued to serve people that they know to be drunk. It’ a heck of a problem,” Day says. Furthermore, the Drug Dealer Liability Act imposes liability on a drug dealer for their customers who cause injury to somebody else. “We successfully used the act to sue a pedophile who was giving narcotics to his victim. That law provides extra special protections and rights against the users of illegal narcotics,” Day said. For more information about holding a drunk or impaired driver responsible, visit http://www.johndaylegal.com. John Day writes a blog on personal injury law on http://www.Dayontorts.com. He can be reached at 866-812-8787.
