All the Michigan Motorcycle laws described here apply to two- and three-wheeled vehicles with a seat or saddle that are capable of going more than 30 miles per hour. This includes many mopeds and “trikes” There are some “mini choppers” that are excluded from the registration requirement because they are missing necessary safety equipment and are not legally allowed on public roads. License and Motorcycle Endorsement Laws Half of all Michigan bikers are riding without a proper license. To legally ride in Michigan, you need to get a motorcycle endorsement (CY) in addition to your regular driver’s license. Riding without a CY endorsement could land you points on your license and take money out of your pocket. A motorcycle safety course is required for riders under 18 seeking the endorsement. Older riders are not legally required to take the course. You can also get a Temporary Instruction Permit (TIP) to learn to ride on the roads. A TIP allows you to ride: Under the visual supervision of an adult licensed motorcycle operator. • During daylight hours. • Without a passenger. • Registration Requirements All street-legal motorcycles must be registered with the Secretary of State. This registration is renewed each year. When you register your bike for the first time, you will need to present your title and proof of at least $20,000/$40,000 public liability insurance, as well as $10,000 property damage coverage. Michigan motorcyclists are not legally required to maintain no-fault insurance. Michigan Motorcycle Helmet Laws You are required to wear a helmet whenever you ride a motorcycle in Michigan unless you: • Are 21 years old; • Have $20,000 in first-party PIP motorcycle insurance; • Have held a motorcycle endorsement for at least 2 years; and • Have passed a motorcycle safety course. Where You Can Ride When you are riding your motorcycle you are entitled to the full width of your lane. Bikers often choose to ride two across, which is also allowed. Motorcycles with less than 125 cc engines are not allowed on Michigan freeways or limited access highways. Drinking and Driving Motorcycles is Illegal It is illegal to operate a motorcycle if: • You are visibly intoxicated or impaired due to drugs (including prescriptions) or alcohol. • Your blood alcohol content is above 0.08. • You have any amount of a Schedule 1 drug or cocaine in your system. Taking a few minutes to review off-road safety could save your money, your record, and even your life. All-Terrain Vehicles (ATVs) don’t count as motor vehicles for most of the laws in Michigan. That can make it tough to know what the law is. Here’s a run down of how Michigan treats its Off Road Vehicles (ORVs). Age Limits Under Michigan ATV Laws Not everyone can ride an ATV in Michigan. Unless they are helping with the family farm, kids can’t ride 4-wheel ATVs, even if they are child sized. But they can still ride 2-wheel ORVs like dirt bikes under parental supervision with the proper certification. Children ages of 10 to 16 are only allowed to ride ATVs if they have completed an ORV Rider Safety Education Course, and are under visual supervision of an adult. Where they can ride depends on their age. At age 10 and 11, kids can only ride on land belonging to their parents. If you are making sure your child is properly equipped with safety equipping before getting on a bicycle, do the same service for yourself and wear a properly fitted helmet every time you ride. Nighttime Cycling There are certainly times of day that are more favorable to bike riders. Getting on two wheels during daylight hours will reduce your risk of being involved in an accident with a motor vehicle. If you must get on your bicycle at night, be sure to take all precautions to increase rider visibility by wearing reflective clothing and affixing lights to your bike. Off-Lane Bicycle Riding Where you choose to ride affects the probability of getting into an accident. Ideally, you are riding within bike lanes that are clearly marked. If your route takes you onto less-traveled roads or narrower highways that do not have designated bike lanes, it’s essential to be extra-careful about your surroundings and the cars zooming by you – you cannot trust that the motor vehicle operators will all be cautious enough to keep you safe. Inexperience Every cyclist has to start somewhere, but the more inexperienced you are as a bicycle ride right alongside motor vehicles, the greater your chances of being involved in an accident. Practice, study, and memorize the rules of the road, especially if you are a newbie bicyclist. Veteran bicycle riders have the benefit of familiarity with the roads they travel and the rules that govern them, as well as the ability to make better quick decisions in a critical situation. Smartphone Usage Bicyclists in Michigan are not legally prevented from using a cell phone while they cycle. As a result, some cyclists do use their smartphone while riding their bicycle, and this distraction can lead to preventable accidents with another cyclist, pedestrians, and motor vehicles. Anything But Independent Because you are asking to be compensated for a medical condition, the insurance company and individual defendants have the right to have their own doctor evaluate your injury and recovery. Even though these examinations are called independent, there is nothing neutral about the evaluation. The IME is done by a doctor your opponent hand selected and paid. Often insurance companies use the same doctors on a very regular basis because they have gotten the results they were looking for. Instead, they go to the person’s dependents. In a fatal auto accident case, the person who died is called the “decedent” or the “deceased.” Were this person still alive he or she would be entitled to no-fault benefits, but because he or she has died, someone else must file the claim and bring the lawsuit on his or her behalf. The resulting no-fault benefits are paid to the deceased’s dependents. What are Survivors’ Benefits? Dependents of a deceased no-fault insurance policy holder are entitled to many of the same benefits as if the person survived. But some benefits are calculated differently. Funeral and Burial Expenses. In addition to medical expenses resulting from an auto accident, dependents can recover reasonable burial and funeral expenses. Lost Income. A survivor’s income loss is broader than wage loss and includes fringe benefits, like health insurance that the decedent’s employment would have provided, plus lost wages, salary, and other income. Replacement Services. Dependents are entitled to up to $20 per day to pay for lawn care, child care, and other household services that the deceased could have performed, but now need to be hired out. The survivors’ benefits are capped at a rate that increases each year. It is currently just over $5,300. They can: Request documents from the other party, including you, or subpoena them from outsiders, including your medical records. The defendants are allowed to review your diagnosis and verify that your injury arose from the accident, and not before, because you are asking to be compensated for the injury. Ask written questions called “Interrogatories” that must be answered under oath. These are usually straightforward questions about your background, employment history, injuries, and treatment. Require witnesses or parties, including you and the defendants, to answer questions under oath at a “Deposition” which are recorded by a court reporter. Your attorney will help you prepare for your deposition ahead of time, so you will be ready. You may also be asked be seen by a doctor hired by the insurance company, called an “independent medical examination.” This exam is clearly not independent and will almost always support the defendants’ claims that your injuries are not related to the accident or have reached full recovery. But what is the MCCA and how does it work? In 1978, the Michigan legislature added MCL 500.3104, which created the Michigan Catastrophic Claims Association (MCCA). This unincorporated, non-profit entity is made up of all the licensed auto insurance providers in the state. It has one job: to cover catastrophic medical expenses from car crashes in Michigan. Here’s how it works. The MCCA collects a fee from every insured driver in Michigan, paid through their auto insurance policies. The fee is calculated based on the number of vehicles each provider covers. In 2015, the Michigan Catastrophic Claims Assessment was $150.00 per vehicle. All that money pools together in the care of the Michigan Catastrophic Claims Association. Then, when a motorist is seriously injured in an auto accident, her insurance company can look to the MCCA for help paying for her medical expenses. The MCCA only applies in the most serious of auto accidents. The amount at which an auto insurance provider is allowed to turn to the MCCA for help goes up a little every year. In 2015, the amount is $545,000. If more than one person is injured in an accident, each one needs to reach that amount before his claim can be submitted to the MCCA. In most car crashes there is no question: when a car hits a car and you were in one of them, a motor vehicle accident has occurred. But what if a car hits a person? Or what if two motorcycles collide? What counts as a motor vehicle? The No-Fault Act defines motor vehicle as “a vehicle, including a trailer, that is operated or designed for operation on a public highway by power other than muscular power and has more than 2 wheels.” Let’s break that down: • A motor vehicle needs to have more than 2 wheels. That means motorcycles and mopeds don’t count. • The device has to be intended for use on a public road. That means go-carts and golf carts don’t count. • Motor vehicles need to be powered by something other than your muscles. That cuts off bicycles, tricycles, wagons, scooters, and other rider-propelled toys. Michigan law also explicitly excludes off-road vehicles (ORVs), commercial quadricycles, battery operated wheelchairs, and unregistered farm equipment, like tractors. There is no law demanding that citizens wear a helmet while riding a bicycle, but common sense should prevail in this situation. • Wear reflective gear. If you’re going to be a cyclist who chooses to ride alongside motor vehicles, do yourself and other drivers the favor of wearing the proper gear so that you can be seen in shaded areas and especially at night. • Do not use your cell phone. You need two hands to operate a bicycle. While veteran cyclists or overconfident newbies may feel completely comfortable riding their bike while using a smartphone, resist the temptation. Keep both hands on your bike, and don’t allow yourself to be distracted by ear buds. • Choose routes with bike lanes. When an area of the city or suburbs has designated bike lanes, use them! If you own a car you must have coverage that protects you in an accident. Even as a passenger or pedestrian, you are still covered. Your no fault insurance policy includes lost wages compensation. After an accident, your insurance company is required to pay 85 percent of your lost income for up to three years. You can use this benefit to cover unpaid time off for medical exams and doctors visits, to pay your bills during your FMLA medical leave, or to bridge the gap if your condition causes you to lose your job. If you happened to be unemployed when the accident happened, you can still receive lost wages benefits as long as you were actively seeking employment. No matter how much time a teen has spent in driver’s ed or practicing their skills with an adult riding shotgun, it’s a simple fact that teens are not experienced drivers. They may be quicker than you, but when it comes to driving a teen’s reflexes are stunted by their ability to make the best decision in the moment. Plus, many teens believe that they are infallible. But they are more likely to crash than older drivers because they are simply not experienced enough on the roads. • Teen drivers are distracted. Distracted driving is an epidemic, and it has hit the teen demographic quite hard. Plenty of teens live by and, sadly, some die by their smartphones. But who pays for those medical expenses can sometimes get complicated, particularly when government benefits get involved. MCL 500.3109 and MCL 500.3109a apply to subtracted benefits and coordinated coverage. These statutes explain when your auto insurance provider is allowed to subtract or “set-off” benefits you receive from other sources. Subtracted Benefits Any time an accident victim is entitled to benefits under state or federal law, those payments can be subtracted from what the auto insurer has to pay. For example, if a truck driver is injured on the job, he may be entitled to Workers’ Compensation benefits. Because this is mandated by law, whatever he receives from Workers’ Comp will reduce the benefits he receives from his no-fault provider. Other set-off benefits could include social security payments or certain survivor benefits. Coordinated Coverage Where subtracted benefits are automatic, coordinated coverage is optional. The Michigan No-Fault Act allows auto insurance providers to offer reduced-price policies if those policies are coordinated with a health insurance policy. Without this provision, your auto insurance provider would pay all of your medical expenses after an accident – even those that could otherwise be paid using your health insurance. Hundreds of thousands are injured. This is a growing problem in Michigan which is only getting worse. If you are texting while driving you are three times as likely to get into an auto accident as when you have put the phone away. Distracted Driving can very easily lead to serious motor vehicle accidents. During the average 5 seconds it takes to send a text, a driver on the highway can cross an entire football field. While 5 seconds doesn’t seem very long, a car making a quick lane change or a sudden back up could make the difference between life and death. Younger drivers are at particularly high risk for a distracted driving accident. Nearly half of all teens with cell phones admit to texting while driving. One-third call texting while driving easy. Even so, one in ten crashes involving drivers under age 20 involved a cell phone. Because the drivers in these accidents are distracted, they are often higher speed impacts than other accidents on the same roadways. The higher the speed, the more likely a car crash will result in serious injuries. So distracted driving accidents are especially likely to result in death or disability.
